These Terms of Service apply when you use www.rhucello.co.uk or purchase products from us.

Please read them carefully before placing an order. By using our website or placing an order, you agree to these terms.

In these terms, “Rhucello”, “we”, “us” and “our” refer to Rhucello Limited.

2. Who may purchase from us

Our products contain alcohol. You must be aged 18 or over to place an order through our website.

By placing an order, you confirm that:

• You are aged 18 or over.
• The person receiving the delivery is aged 18 or over.
• The information you provide is accurate and complete.

Proof of age may be requested before an order is accepted or when it is delivered.

If satisfactory identification cannot be provided, delivery may be refused and the order may be returned to us. We may also refuse or cancel an order where we reasonably believe that the purchaser or recipient is under 18.

Acceptable identification may include a valid passport, photocard driving licence or recognised proof-of-age card.

3. Our products

We take reasonable care to ensure that product descriptions, photographs, prices, bottle sizes, alcohol strengths and other information on our website are accurate.

Product images are provided for illustration. Colours and appearance may vary slightly depending on lighting, packaging updates and the screen or device being used.

Because Rhucello is made in batches using natural ingredients, minor differences in colour or flavour may occur. These variations do not normally mean that the product is faulty.

All products are subject to availability.

4. Placing an order

When you place an order, you are making an offer to purchase the products in your basket.

After placing an order, you should receive an email acknowledging that we have received it. This acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and Rhucello is formed when we confirm that your order has been accepted or dispatched.

We may refuse or cancel an order before dispatch for reasons including:

• The product is unavailable.
• Payment has not been authorised.
• The price or product information contained an obvious error.
• We are unable to deliver to the address provided.
• We are unable to verify that the purchaser or recipient is aged 18 or over.
• We reasonably suspect fraud, misuse or unlawful activity.

If we cancel an order after payment has been taken, we will refund the amount paid.

5. Prices and payment

All prices are shown in pounds sterling and include VAT where applicable.

Delivery charges are shown separately during checkout and before you submit your order.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

Payment must be made using one of the payment methods offered at checkout. Payments are processed by Shopify Payments or another payment provider displayed during checkout.

We do not normally receive or store your full payment-card details.

6. Mistakes in pricing or product information

We try to ensure that all prices and product details are correct.

If we discover an obvious error before accepting your order, we will contact you and give you the option of continuing with the corrected information or cancelling the order.

We are not required to supply a product at an obviously incorrect price where the mistake could reasonably have been recognised as an error.

7. Delivery

We currently deliver to eligible addresses within the United Kingdom, subject to the areas and restrictions shown during checkout.

Estimated dispatch and delivery times are explained in our Shipping Policy.

Delivery estimates are not guaranteed unless we expressly agree a specific delivery date with you.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by you.

Your order remains our responsibility until it has been delivered to:

• You;
• A person identified by you to receive it; or
• A safe place or neighbour specifically authorised by you.

Once delivered to an authorised recipient or location, responsibility for the products passes to you.

Ownership of the products passes to you once we have received payment in full and the products have been delivered.

8. Failed delivery and age verification

Someone aged 18 or over must be available to receive the order where the delivery service requires this.

The courier may ask the recipient to provide photographic identification.

If delivery cannot be completed because:

• Nobody aged 18 or over is available;
• Suitable identification cannot be provided;
• The address is incorrect or inaccessible; or
• Delivery is refused,

the parcel may be returned to us.

Where a failed delivery was caused by information or circumstances within your control, we may deduct reasonable return or redelivery costs from any refund, where legally permitted.

9. Delays outside our control

We are not responsible for delays caused by events outside our reasonable control, such as severe weather, courier disruption, industrial action, transport failures or other unexpected events.

If a significant delay occurs, we will try to contact you and take reasonable steps to minimise its effect.

Where the delay is substantial, you may be entitled to cancel your order and receive a refund for products that you have not received.

10. Cancelling an order

You may contact us to request cancellation before your order is dispatched. We will try to stop the order, although this may not be possible once packing or dispatch has begun.

Consumers purchasing online normally have a statutory right to cancel their order within 14 days after receiving it, without giving a reason.

We also offer a 30-day return period for eligible unopened and unused products.

Nothing in these terms affects your statutory rights.

11. Returns and refunds

To request a return, contact info@rhucello.co.uk before sending anything back.

For a change-of-mind return, products must normally be:

• Unopened and unused;
• In their original packaging;
• With the bottle seal intact; and
• Accompanied by proof of purchase.

You are normally responsible for the cost of returning a change-of-mind purchase.

Where you cancel an entire eligible online order within the statutory cancellation period, we will refund the standard outbound delivery charge. Additional amounts paid for express or enhanced delivery are not normally refundable.

Opened bottles or bottles with a broken seal may not be eligible for a full change-of-mind refund because they cannot be resold. This does not affect your rights where a product is faulty, damaged, incorrect or not as described.

12. Faulty, damaged or incorrect products

We are responsible for supplying products that are:

• As described;
• Of satisfactory quality; and
• Fit for their normal purpose.

Please inspect your delivery when it arrives.

If an order is damaged, faulty, incorrect or not as described, contact us as soon as possible at info@rhucello.co.uk. Please include your order number and photographs of the product and packaging where possible.

Depending on the circumstances and your legal rights, we may offer:

• A replacement;
• A repair, where appropriate;
• A partial refund; or
• A full refund.

Rhucello will cover reasonable return costs for products that are faulty, damaged in transit, incorrect or not as described.

Your statutory rights are not affected.

13. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions shown when they are offered.

Unless stated otherwise:

• Discount codes cannot be exchanged for cash.
• Only one discount code may be used per order.
• Codes must be entered before checkout is completed.
• Discounts cannot normally be applied retrospectively.
• Promotions may be withdrawn or changed before an order is placed.
• Minimum-spend, product or expiry restrictions may apply.

Promotional and sale items remain covered by your statutory rights.

14. Personal use only

Our online store is currently intended for consumers purchasing Rhucello for personal use.

You must not purchase products from the website for unauthorised resale, commercial redistribution or export.

Trade customers should contact us separately before placing an order intended for resale.

15. Using our website

You may use our website only for lawful purposes.

You must not:

• Use the website fraudulently or unlawfully.
• Attempt to gain unauthorised access to the website or its systems.
• Introduce viruses, malware or other harmful technology.
• Interfere with the operation or security of the website.
• Collect customer or website data without permission.
• Use automated systems to scrape, copy or reproduce website content.
• Place false, misleading or fraudulent orders.
• Impersonate another person or provide false information.

We may suspend or restrict access where we reasonably believe these terms have been breached.

16. Intellectual property

The website and its contents, including the Rhucello name, branding, logos, photographs, designs, graphics, text and product descriptions, belong to Rhucello Limited or are used with permission.

You may view and use the website for personal, non-commercial purposes.

You must not copy, reproduce, modify, distribute, publish, commercially exploit or create derivative works from our content without prior written permission.

17. Reviews and content submitted by customers

Where you submit a review, photograph, comment or other content, you confirm that:

• The content is your own or you have permission to submit it.
• It is accurate and not misleading.
• It does not infringe another person’s rights.
• It is not unlawful, abusive, defamatory, discriminatory or obscene.

You give us permission to display and reproduce submitted content for operating and promoting Rhucello.

We may remove content that breaches these terms or is otherwise inappropriate.

18. Third-party services and links

Our website may contain links to third-party websites or use services operated by organisations such as Shopify, payment providers, couriers and social-media platforms.

We are not responsible for the content, availability or privacy practices of third-party websites that we do not control.

Your use of a third-party service may be subject to that organisation’s own terms and policies.

19. Privacy and cookies

We use personal information in accordance with our Privacy Policy.

Our website also uses cookies and similar technologies. More information and privacy controls are available through our cookie banner and privacy settings.

20. Our responsibility to you

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for:

• Death or personal injury caused by our negligence;
• Fraud or fraudulent misrepresentation;
• Breach of your statutory consumer rights; or
• Any other liability that cannot legally be excluded.

We are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was made.

Because our website is intended for consumers, we are not responsible for business losses, including loss of profit, revenue, business opportunity or commercial reputation.

Nothing in this section affects your statutory rights.

21. Your responsibility

You are responsible for:

• Providing accurate contact, payment and delivery information.
• Ensuring that you and the intended recipient are aged 18 or over.
• Following reasonable storage and serving instructions.
• Keeping account login details secure.
• Using the products responsibly and lawfully.

The terms applying to your purchase will normally be those in force when you place your order.

The latest version will be published on this page with an updated date.

23. If part of these terms is invalid

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

24. Delayed enforcement

If we do not immediately enforce a right under these terms, this does not mean that we have waived that right.

25. Transferring this agreement

We may transfer our rights and obligations under these terms to another organisation, provided that this does not reduce your legal rights.

You may transfer your rights under these terms only with our written agreement, except where the law allows otherwise.

26. Governing law

These terms and any contract between you and Rhucello are governed by English law.

If you live in England or Wales, the courts of England and Wales will generally have jurisdiction.

If you live in Scotland or Northern Ireland, you may bring proceedings in the courts where you live and retain any mandatory consumer protections that apply there.
